Terms of sale and general terms and conditions for background images of dealer advertising templates and billboard template from the JACK WOLFSKIN archive
1. All supplied image data via e-Wolf are made available exclusively on a loan basis. These are photographic images according to Section 2 of the German Copyright Act (UrhG) for which the copyrights are held by the photographer or by JACK WOLFSKIN Ausrüstung für Draussen GmbH & Co. KGaA, Idstein or INTENTION Werbeagentur, Bonn.
2. The data in the given layout may only be used for JACK WOLFSKIN dealer advertisements and billboards. Use for other advertising purposes is prohibited. They may not be used in connection with other dealers or brands.
3. The image data may not be passed on to third parties for other uses. They may not be archived by your service providers (e.g. Lithostudio).
4. All publications must be approved by JACK WOLFSKIN in advance.
5. JACK WOLFSKIN must receive a record of all publications as documentation for the holder of rights.
6. The licence for the images is for a restricted time period. The licence period is applicable from 1st of February 2021 to 31st of July 2021. After this time period, the images may no longer be used.
7. Should this contract be contravened, the licences can be revoked immediately. Should the photographs be used in a way that contravenes the contract, we have the right to demand double the usual licence fee.
8. The user is liable for claims by photographers or depicted persons arising from use of the photograph in a way that contravenes the agreement. The user bears responsibility for the text accompanying the images and/or for other all distorting image compositions. Should this responsibility be infringed, JACK WOLFSKIN is exempted by the user against all claims by third parties.
9. For all regulations, the law of the Federal Republic of Germany is also applicable. The place of jurisdiction is Idstein. Written agreements alone have authority. Should individual provisions of these general terms and conditions become nullified, this will not affect the remainder of the terms. The invalid term must be replaced by a valid term corresponding in meaning to the nullified term.
I have read the general terms and conditions for the use of pictorial material from the JACK WOLFSKIN archive in full and agree to all the terms contained within it, and am authorised to make this declaration on behalf of my company.
